The truth about NFA weapon ownership

There are a many myths surrounding the ownership of National Firearms Act weapons more commonly known as NFA weapons. These include Machine guns, Suppressors, more commonly known as silencers, short barreled rifles and short barreled shotguns commonly called “sawed off shotguns”. Here are some facts that will dispel some of the myths, misconceptions and outright lies about ownership of these types of weapons.

Myth: “Private Citizens can’t own machine guns & silencers”

Truth:   Any Nebraska citizen that can legally own a handgun can own an NFA weapon.

Myth: “You have to have some kind of special Class 3 license to own NFA weapons.”

Truth:   No special license is needed to own these weapons. The registration process is a simple one page tax form (ATF form 4) that needs to be filed with the BATF.

Myth: “It can take 6 months to a year to get your ATF form 4 approved”

Truth:  In the old days when the ATF was run by the department of the treasury, transfers did take an exceedingly long time. However in recent years the ATF has been handed over to the Justice Department and is now run by a younger more professional staff that is truly there to help expedite the transfer process. Now transfers typically take 3 to 8 weeks.

Myth:  “You have to pay $200 a year to keep a NFA weapon”

Truth:   You pay a one time tax of $200. You never have to pay that tax again on that weapon. You can will it to your heirs and they will never have to pay the tax.

Myth:  “Only gangsters & drug dealers own machine guns”

Truth:   Gangsters & drug dealers don’t own NFA weapons. They don’t’ go through the legal process to own the collectable weapons. Doctors, lawyers and bankers own machine guns along with thousands of other law abiding US citizens.

Myth: “Silencers are for “hit men” & assassins”

Truth: Silencers don’t actually silence the gun. They just suppress the sound to a level where hearing protection is not required. Responsible shooters own suppressors as a way to be courteous to your neighbors and control noise pollution.  Hunting with suppressors is legal in Nebraska for all game that can be hunted with a rifle. Suppressor are also invaluable in controlling varmints and dangerous animals. You can shoot prairie dogs with a suppressor.
